Terms of use

The rules that apply to this website and to digital banking, alongside the specific terms of each product you hold.

This document is a template prepared for this platform and must be reviewed by qualified counsel in each jurisdiction before publication.

1. About these terms

These terms govern your use of the Upstate Corporate website and digital banking platform. Product-specific terms apply in addition to these and prevail where they conflict.

By using the site you accept these terms. If you do not accept them, do not use the site.

2. Eligibility

Accounts are available to applicants who meet our eligibility criteria, pass identity verification and, where relevant, satisfy affordability and suitability assessment.

Product availability varies by jurisdiction. Nothing on this site is an offer where we are not licensed to provide the service.

3. Information on this site

Rates, fees and figures shown on this site are illustrative unless expressly stated to be a quotation. Calculator outputs are estimates based on the values you enter.

Articles and guides are general financial education, not personal advice or a recommendation to buy any product.

4. Your responsibilities

Keep credentials, devices and one-time codes secure and do not share them with anyone, including anyone claiming to represent us.

Provide accurate information during application and keep your contact details current so we can reach you about security matters.

Notify us immediately if you suspect unauthorised access, a lost card or a fraudulent instruction.

5. Acceptable use

Do not attempt to gain unauthorised access to the platform, interfere with its operation, scrape it at scale, or use it for unlawful purposes including money laundering or sanctions evasion.

We may suspend access where we reasonably suspect misuse, fraud or a legal obligation requires it.

6. Availability

We aim for continuous availability but planned maintenance and incidents can interrupt service. Where practical we give notice of planned downtime.

Some functions depend on third-party payment networks whose availability is outside our control.

7. Intellectual property

All content, design, code and branding on this site belong to Upstate Corporate or its licensors and may not be copied or reused without permission.

8. Liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for statutory rights that apply to your account.

Otherwise, and to the extent permitted by law, we are not liable for indirect or consequential loss arising from use of this site.

9. Complaints and governing law

Complaints can be raised through secure messaging or at clientservices@upstatecorporate.online. We will acknowledge and investigate within the periods set out in our complaints procedure.

These terms are governed by the law of the jurisdiction in which your account is held, as specified in your product terms.

Upstate Corporate is a fully licensed banking institution, authorised to accept deposits and provide credit, payment and wealth services. Licensing details are available to clients on request.

All credit products are subject to application, eligibility criteria, affordability assessment and approval. Rates and terms are confirmed in your credit agreement.

Investment and retirement products are not deposits. Their value can fall as well as rise and past performance does not indicate future results.
